What is Probate?Probate is a legal procedure where a Court recognises that a deceased person’s Last Will and Testament is valid. The executor/s of the will apply to obtain probate from the court so that they have legal authority to deal with the deceased person’s assets and liabilities and to distribute these in accordance with the will.

More InformationThe executor/s apply in writing to the Registrar of the High Court who then carries out probate, which involves proving that the will was genuine and made in the correct way and was properly signed by the deceased person and witnessed correctly. The Registrar also ensures that executors have been appointed.
